BS4 vehicles supreme court Order: No More Sale of Bs4 Vehicles

        The Supreme Court had said in October 2018 that no BS-IV vehicle would be sold in India from April 1, 2020. In 2016, the Government said that India will avoid BS-5 standard vehicles and will directly adopt BS-6 standard vehicles by 2020.

 

The Supreme Court said on Monday that the sale and registration of BS-IV standard vehicles are not allowed in the country as the pollution caused by such vehicles will be dangerous.

 

The Supreme court expressed displeasure over the violation of its March 27 order through which it allowed a limited number of 10-day sales of BS-4 vehicles in India, excluding the Delhi-NCR region after the coronavirus lockdown was lifted.

 

Sale and registration of BS-4 vehicles not allowed

The court said on March 27 this year that it was allowing 10 percent sale of BS-4 vehicles which could not be sold to compensate for the six days lost due to the lockdown implemented on March 25. The supreme court had earlier set March 31, 2020, as the deadline for the sale of BS-IV standard vehicles. It also approved the registration of 1.05 lakh two-wheelers, 2,250 passenger cars, and 2,000 commercial vehicles which were sold, but could not be registered.

 

The court had said in October 2018 that no BS-IV vehicle would be sold in India from April 1, 2020. In 2016, the Government said that India will avoid BS-5 standard vehicles and will directly adopt BS-6 standard vehicles by 2020.

 

A bench of Justice Arun Mishra and Justice S Abdul Nazir heard the case on Monday through video conference, saying that it is shocking to mention that even after the lockdown was lifted on May 3, when the sale took place and in line with our order, this There can be no registration without informing the court how many vehicles have been sold in India.

 

"It is clarified that no sale and registration of BS-IV vehicles is allowed," the bench said in its order. The court said that vehicles sold out of 10 percent cannot be registered without its permission and submit the details as per the order given by the court in March.

 

Order violation-

The bench said, "There has been a clear violation of the second part of the order given by this court (on 27 March). An incomplete affidavit has been filed on 13 June 2020." The bench said that the first part of its order has also been violated.

 

Next hearing will be held on June 19, 2020

The bench asked the Additional Solicitor General ANS Nadkarni presented by the Center to collect details from all RTOs about how many BS-4 vehicles have been sold in the country after the removal of the coronavirus lockdown. At the same time, the next hearing in the case will be held on June 19.
